Loss or Damage in Transit
All goods are shipped at the customer’s risk. Delivery of products in good order by Gemini to the carrier, therefore, constitutes delivery to the customer. For Goods Shipped via Motor Freight Should loss or damage occur in transit, as evidenced by damage to the shipping container, the customer should inspect the products carefully (prior to signing delivery receipt) and make a claim immediately against the carrier.
For Goods Shipped via FedEx
Should loss or damage occur in transit, all packages should be inspected prior to signing delivery receipt. Immediately notify FedEx in your area of all damages. A “Damage Call Pick-Up Number” will be needed prior to shipping to Gemini, for credit purposes.
Damaged goods returned must be accompanied by proof of purchase via bill of sale or copy of original invoice.
Shortages or Warranty claims
Customer must make claims for shortages to the selling distributor or Gemini within five (5) working days from receipt of the products.
Claims for unreceived shipments must be reported within thirty (30) days of the invoice date.
Goods found to be defective during the warranty period must be accompanied by proof of purchase via bill of sale or copy of original invoice. Call (520) 307-7823 to obtain authorization for return of defective product.
Returns and Credits
No products may be returned without express authorization from Gemini Bath & Kitchen Products. A Return Goods Authorization number (RGA #) must be obtained from Gemini, and must be identified on the outside of the return packing.
Products returned for re-stock must be in original condition, suitable for resale. Products not in first-class stock condition will not be accepted. All transportation charges for returned goods must be paid by the customer.
Within fifteen (15) days after obtaining return authorization, carefully repack any opened containers and ship the returned products in another, outer carton. Be sure to include the RGA form and mark the outside of the cartons with the assigned RGA number.
A restocking charge amounting to thirty-five percent (35%) of the value of the order will apply to all products returned within 30 days of invoice date, payable upon inspection and acceptance of the products by Gemini.
All returns made after thirty (30) days of our returned goods authorization (RGA) and\or invoice date, will be subject to a fifty percent (50%) restocking charge.
Products held for longer than ninety (90) days from date of shipment cannot be considered for return.
Open credit memos and credit balanced NOT used after one (1) year are voided and cleared from our system.
Gemini products are warranted to be free from defects in materials and workmanship for two (2) years following the date of sale to the users.
This warranty does not cover:
- The product finish or its wearing quality.
- Any obligation other than the replacement of defective parts when presented to the selling distributor, together with proof of purchase, during the warranty period.
- Any labor charges, removal or reinstallation expense, freight or postage, or any incidental or consequential damages caused by any product, defective or otherwise.
- Products classified as “accessories” or “replacement parts”. This warranty shall be voided by any of the following:
- Modification of any product.
- Improper installation of the product.
- Use of product for any purpose other than that for which specifically intended.
This warranty supersedes all other warranties, expressed or implied.
The forgoing warranties are exclusive and made only to the Buyer — NO OTHER WARRANTY, WHETHER EXPRESSED, IMPLIED, OR STATUTORY, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE SHALL EXIST IN CONNECTION WITH ANY OF THE GOODS OR SERVICES SUPPLIED HERE UNDER, AND ALL SUCH WARRANTIES ARE HEREBY EXPRESSLY EXCLUDED.
Gemini is a distributor of high quality international products. Each original manufacturer is a market leader in their respective country. The original manufacturer is the sole owner of all code approvals and certifications for their products. These manufacturers have certifications with many major international organizations. Certifications are outside the control of Gemini, Gemini can not guarantee specific certification or registration with every possible local code worldwide.
No employee, agent, or other person is authorized to give any warranties on behalf of Gemini in addition to or different from those herein given to assume for Gemini any other liability in connection with any of its products except in writing which is signed by an officer of Gemini and expressly and intentionally gives such warranties or assumes such liability.
